d9a3c92b5b tests: kernel: mpool: fix assert side effect

516e155bb5 tests: update to Apache 2.0 SPDX tags on new tests 
Some new tests were added that had the Apache 2.0 boilerplate licensing
instead of the SPDX licensing tag.
